I own a flat in a Co. Op. Hsg. Soc. in Mumbai since June 2011. I have kept the flat locked and visit it once or twice a month. I have never given the flat on rent. I have maintained the flat well and have not caused any disturbance or nuisance to other occupants in the building. I am also paying the monthly society and BMC dues regularly.  The Society has started charging me additionally charges per month as non occupation charges from February 2015 without any prior information or notice. Is the society justified in charging me the extra non occupation charges? How do I get rid of paying the non occupation charges?

Ans:
The society is not supposed to charge non occupancy charges to the flats which are kept vacant or is kept in the possession of the flat. The flats which are given on rent only can be charged non occupancy charges.
