Sexual assault victim denied chargesheet, undergoes depression treatment

In yet another incident of insensitivity and apathetic attitude by the city police force, the Bandra police are in the eye of the storm for letting criminals accused of committing a serious crime such as sexual assault roam freely on the streets.

The incident took place two years ago in the Dargah Galli slums in Maulana Baba Lane in Bandra (W), where the victim Nilofer Hafiz Sheikh resides. Three accused persons who have been named in the FIR filed on November 23, 2017 are Nawaz Kazi and his sons, Ali and Akbar. They have been accused of sexually assaulting Sheikh and tearing her clothes when she tried to intervene and save a senior citizen from being beaten up. This paper had reported (Peacemaker bears brunt of sexual assault, November 22, 2017) on how the police were not conducting a fair and focused probe into the incident. The accused live in the same vicinity as the victim.

Sheikh claims that the police who are hardly serious about probing the case and verifying facts related to the incident, are making her run for the chargesheet, forcing her to visit the Bandra police station five times already. Each time the cops have cited a new reason for denying and delaying, she alleges.

The 42-year-old dwelt on the FIR copy given with Sections (pertaining to gang rape, outraging a woman's modesty, criminal intimidation) 376, 376(D), 354, 506 and 34 being mentioned within. When she was not paid heed to earlier, she drank rat poison outside the police station and tried to kill herself. Sheikh was later rushed to the civic-run Bhabha Hospital, where she lay recovering for three days.

“If I don't get justice then this time I will end my life and the police will be responsible. Every time I see those accused moving around freely, I'm enraged. There should be an unbiased and impartial probe. I am being tested for depression. They (police) have not visited the spot even once or come to verify my claims. The witnesses' statement too has not been recorded. Every time I go to the police station, they give me an excuse and I am denied the chargesheet,” says a sobbing Sheikh.

The Department of Psychiatry has confirmed her treatment. A medico-legal examination report of sexual violence was given by the Bhabha Hospital. Meanwhile, the rape charges have been dropped in the chargesheet.

“You can access the copy of the chargesheet, which has been filed with the court. I don't know much and don't ask me anything. However, a medical test of the accused was not done,” Padmakar Deore, Police Inspector (admin), said on the phone as she hurriedly hung up.
