Man gets 20-year-jail for sexual assault on minor

A special court sentenced a 50-year-old man to 20-years rigorous imprisonment yesterday for sexually assaulting a four-year-old child, his neighbour.

According to the police complaint, the child who used to frequent the man's house everyday since the man's niece was her friend, had been refusing to go to the man's house for some days. When her mother asked her the reason, she had told her mother that 'uncle' beats her on her arms and legs, but her mother had not given this much attention. One such day in August 2016, when the child had not gone to his home, he asked her mother why she had not come. To this the mother replied that it is because he beats her. The man explained that he had scolded the child since she was not studying and asked her mother to send the child to him for studies.

Later, when the man called out to the child to come to his home for eating pulav, she refused to go and the mother informed him that she had already eaten food. Then he asked the child to be sent for studies. This time the child went. After some time, the mother realised that the man's son has left the house and the child must be alone with the man in his home. When she went to check on her daughter and clandestinely looked into his house she found that he had partially undressed the child and was touching her inappropriately. Frightened, the mother called out to the child. On seeing this, the man quickly dressed the child. She took the child home. Thereafter, on being taken into confidence, she narrated to her mother that the man used to beat her, touch her inappropriately and show his private part to her.

A police complaint was then lodged. On medical examination on the child's genitals, it showed that there was recent sexual assault, said special public prosecutor Jyoti Sawant.

Advocate for the accused Ramesh Tripathi said that the recently passed amendment pertaining to child rape was applied retrospectively. The amendment, which came into force on August 2011 has made punishments more stringent.
