Another witness declared hostile in Sohrabuddin case

Yesterday the prosecution declared yet another witness hostile in the Sohrabuddin Sheikh – Tulsiram Prajapati alleged fake encounter case, taking the number of witnesses turning hostile in the case to 58 out of the 85 examined.

Nizamuddin was posted as a police constable in Surajpol police station in 2006 and was part of the escort team which had taken prisoners Tulsiram Prajapati and Mohammad Azam to Ahmedabad court from Udaipur Central jail where they were lodged.

In a statement given to the CBI in 2012, Nizamuddin had said that Station House Officer of his police station Himmat Singh had told him that there is an order from Superintendent of Police Dinesh M N that they must escort prisoners Tulsiram and Azam to Ahmedabad court and that Tulsiram may try to escape from custody and that they must be careful.

Yesterday in court, Nizamuddin said that Singh had not said about an order from the SP. While his earlier statement had said that Himmat Singh had accompanied him to the Udaipur railway station and named five Rajasthan police in civil clothes who were waiting for them at the station, in court he denied that Himmat Singh had accompanied him or that there were Rajasthan police officials in civil clothes waiting for them. Those named are among the accused.

Also according to his statement to the agency, the escort party on reaching Ahmedabad railway station had gone to the government guest house where they stayed all day and the Gujarat police which had come to the station had taken Prajapati and Azam away and he did not know where they were taken. He denied this in court yesterday. It is the prosecution's case that Tulsiram and Azam were taken by the Gujarat police to the ATS office.

In his CBI statement he had identified the railway warrants on which the party travelled and named those who had travelled, which included the accused. In court he said he was not shown any such document by the CBI.

Nizamuddin also refused to identify entries made in Roznamchas which he had identified earlier as per his CBI statement. The Roznamcha entries made by Himmat Singh state that he was going on orders of SP saheb along with constable Nizamuddin on escort duty of prisoners Tulsi and Azam to Gujarat and on his return he had reported the situation to the SP.

Sohrabuddin Sheikh, who had links to the underworld and allegedly had plans to kill an important political leader in Gujarat was killed in an alleged fake encounter by the police. His associate Tulsiram Prajapati who had been a witness to his abduction before the killing was killed a year later in another alleged fake encounter.
